The liability of Esbjerg Survey Ltd. and all its subsidiaries and affiliated companies and offices (collectively referred to as “Esbjerg Survey”) for damage or loss of any kind under any one contract for the provision of services by Esbjerg Survey shall in no event exceed SDR 50,000. All contracts for the provision of services entered into by Esbjerg Survey shall be governed by and construed in accordance with Danish law, and any dispute arising out of or in connection with such contracts shall be settled exclusively by the Maritime and Commercial Court in Copenhagen, Denmark, or, if the Maritime and Commercial Court in Copenhagen is not able to accept jurisdiction, by the District Court at Esbjerg, Denmark.
